Andrew McRoberts from Sands Anderson will be presenting about a variety of topics that pertain to Zoning that go into effect on July 1, 2026 from the General Assembly. These topics will include:
- Accessory Dwelling Units (ADUs): New legislation (SB531/SB932) requires all localities to permit ADUs in single-family residential zoning districts. Localities are prohibited from requiring special use permits for ADUs or mandating a familial relationship between occupants of the primary dwelling and the ADU. Permitting fees for these units are capped at $500. July 1, 2027
- Manufactured Housing: Localities can no longer restrict manufactured homes to agricultural zones only. These homes must now be permitted in any residential zoning district that allows traditional site-built single-family dwellings. July 1, 2026
- Religious and Nonprofit Housing: New laws allow property tax-exempt religious and nonprofit organizations to develop affordable housing by-right on their land, bypassing certain discretionary review processes like special use permits. The bill has a delayed effective date of January 1, 2027, and expires on January 1, 2031. S
